YourView Research Participant Privacy Policy 

This Privacy Notice defines how YourView  Process (collects, stores, uses and discloses and otherwise uses) your Personal Data (“Personal Data” which may also be referred to as Personally Identifiable Information or “PII”) and other information described in this Privacy Notice whether you are a member of a panel (“Panel Member”) of a panel owned by one of our Panel Owners (“Panel Owners”) or are a participant (“Participant”) directed to a survey or other market research program by one of our clients (“Clients”) or Partners (“Partners”). Your participation may also be governed by a privacy notice of one of our Panel Owners. 

WHO IS YOURVIEW AND KLA? 

The Your View panel and website is maintained and administered by KLA, a renowned and well-established market research agency that provides research services and insights to numerous South African companies, including blue chip clients in the financial services, telecommunications and FMCG industries.

Individuals participate in market research on the YourView platform via membership in our panel. Panel Members and Participants participate in surveys or other market research programs for the opportunity to shares view and opinions on questions clients and brands want answers.  receive and redeem rewards and incentives for their participation. 

YourView PROTECTS YOUR PRIVACY 

Registration and participation in our panel is subject to YourView’s Terms and Conditions. You can find YourView’s Terms and Conditions  

Your participation in a survey or other market research program is completely voluntary and YourView’s use of your Personal Data is carried out with your consent. Surveys and other market research programs administered by YourView’s Clients, Partners or other third parties and the data collected in connection with those surveys and other market research programs are not subject to this Privacy Notic 

YourView is committed to the protection of the privacy of Personal Data. YourView strives to conform its privacy practices to applicable laws, codes, and regulations, and the codes of standards of applicable market and opinion survey research associations, including, without limitation ESOMAR (www.esomar.org) and (https://popia.co.za/) . 

HOW IS YOUR PERSONAL DATA COLLECTED? 

Your Personal Data will always be collected by fair and lawful means, for specific purposes. For example, YourView may collect your Personal Data when you register for or participate in our panel. complete a survey, participate in another market research program or via automated means or other methods as described in the “WHAT INFORMATION IS COLLECTED BY AUTOMATED TECHNOLOGIES?” section below. 

YourView only collects Personal Data for market research purposes. 

 

WHAT PERSONAL DATA IS COLLECTED AND PROCESSED? 

  

The Personal Data that is processed may include your name, address, telephone number, e-mail address, date of birth, and other similar information 

From time-to-time YourView may collect Sensitive Personal Data Such as, racial or ethnic origin, health records, financial information, political opinions and religious or philosophical beliefs. If YourView collect your Sensitive Personal Data, YourView will always obtain your explicit consent. 

HOW IS PERSONAL DATA COLLECTED AND PROCESSED? 

YourView may collect and process your Personal Data for a variety of reasons, including: 

  • Enable your participation in our Panel
  • Gather profiling information about you so YourView can better target specific surveys and other market research programs to you.
  • Contact you to invite you to participate in surveys or other market research programs.
  • Manage our incentives programs and fulfil your requests for such incentives.
  • To respond to any messages or requests you may send to us.
  • Validate your profiling information or answers you provided to a survey or other market research program.
  • Recontact for fellow up quests regarding a completed survey
  • Provide service and support to you.
  • Detect and prevent violation of our Terms & Conditions.
  • To investigate suspected fraudulent activity or violation of another party’s rights.

 

Please note that receiving email, WhatsApp or SMS communications may be a requirement of your participation in our surveys or other market research programs. You can opt out from receiving these emails and SMS by unsubscribing from surveys or other market research programs. 

YourView always ensures that it is permitted to process your Personal Data. YourView generally does this by obtaining your consent, however in limited cases, YourView may use a statutory condition to process Personal Data. 

If a statutory condition applies to allow YourView to process your Personal Data and you withdraw consent to process your Personal Data this will not necessarily mean that YourView will cease to process your Personal Data as it may, for example, be under a statutory duty to continue to process your Personal Data for some purposes, e.g., to keep copies of commercial transactions for a minimum of 5(five) years. 

WHAT INFORMATION IS COLLECTED BY AUTOMATED TECHNOLOGIES? 

Cookies 

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information. YourView serves session cookies only. Once the user closes his or her browser, the session is ended, and the cookie simply terminates. For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site. We may also use cookies to track and target the interests of our users to enhance the experience on our site. Users who reject cookies will have limited use of our site. For example, the user will not be able to participate in a YourView research session. Cookies are not linked to any personally identifiable information. 

 

Log Files 

We use IP addresses, browser type, referring URLs, operating system, and date/time stamp to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use in optimizing the performance of our site and our services. IP addresses, etc. are not linked to any personally identifiable information. 

Links 

The YourView Web site contains links to other sites. Please be aware that YourView is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Website. 

WITH WHO DOES YOURVIEW SHARE PERSONAL DATA? 

YourView will not make your Personal Data available to any third party without your consent, unless it is required by law, as further specified below.  

If a survey or other market research program or other activity includes making Personal Data available to a third party, YourView will only share your Personal Data with your consent. If data collected is used for statistical modelling to better understand trends and preferences amongst specific groups or audiences within the general population, only limited Personal Data shared will be used only for market research purposes and again only with your consent.  

YourView may disclose your Personal Data, profiling data, or other research data to third parties as follows: 

  • With Clients of KLA, but in these cases your Personal Data will only be shared with Clients:
  • With your consent, or ii) for permitted research purposes in accordance with the codes of the Insights Association and ESOMAR.
  • in connection with the request or requirement of any lawful request by public authorities, to meet national security or law enforcement requirements;
  • pursuant to required legal process, to the related compelling party;
  • when YourView believes that disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with suspected or actual illegal activity

 

DOES YOURVIEW COLLECT INFORMATION FROM CHILDREN? 

YourView does not knowingly collect Personal Data from children below the age where parental consent is required. If YourView becomes aware that YourView inadvertently collected Personal Data from a child below the age where parental consent is required, YourView will delete such Personal Data from our database. 

YourView: Targets under age responses through their parents who are part of the YourView community.  

YOUR RIGHTS 

You have the right to review, correct, or delete your Personal Data, subject to applicable laws and regulations. Specifically: 

  • Right of access — You have the right to obtain confirmation and information about the processing of your Personal Data
  • Right to rectification — You have the right to have any inaccuracies about your Personal Data corrected
  • Right to erasure — You have the right to have your Personal Data deleted (this right is limited to data which according to law and regulation may only be processed with your consent, if you withdraw your consent for processing)
  • Right to restriction of data processing — You have the right to require that the processing of your Personal Data be restricted (during the course of any investigation into honouring your request, YourView’ s access your Personal Data will be limited)
  • Right to data portability — You have the right to have your Personal Data transferred to another party (this right is limited to data provided by you)

 

In certain situations, however, YourView may not be able to provide access to some Personal Data. 

 

This may occur when: 

  • providing access to Personal Data would be likely to reveal Personal Data about a third party.
  • disclosing the information would reveal confidential commercial information; or
  • the information has been collected for the purposes of a legal investigation.

 

HOW DO I OPT-OUT? 

 

Your decision to participate in a survey or other market research program, respond to any specific survey question or provide Personal Data, including Sensitive Personal Data, will always be respected.  

You may choose whether or not to participate in a particular survey or other market research program, refuse to answer certain questions or discontinue participation at any time. However, failure to provide certain information or fully participate in a particular survey may preclude you from receiving incentive compensation or participation in future research studies.
